On June 3, 2025, Oregon Governor Tina Kotek signed HB 2008 into law to amend the Oregon Consumer Privacy Act,[1] the state’s comprehensive data privacy law. Among other items, effective January 1, 2026, the “sale” of two categories of personal data will be prohibited

  • Precise geolocation information that can pinpoint an individual or device with a 1,750-foot radius, absent some specific communications or utility-related exceptions
  • Personal data of anyone under sixteen years of age, provided that the data controller “has actual knowledge that, or willfully disregards whether, the consumer is under 16 years of age”[2]

The location data provision echoes a similar prohibition that was passed in Maryland last year.[3] 

Location data is considered “sensitive” because it can be readily collected from mobile devices or web browsing activities and can reveal a great deal about an individual’s habits, interests and movements. Beyond targeted advertising, anonymized location data can be a valuable source of alternative data for businesses gathering insights on competitors or consumer foot traffic or migration patterns and population growth.

As a result, the Oregon law – and the possibility of other similar state enactments that could restrict the sale of precise location data – represents an important development affecting data brokers and entities that use such data for location-based advertising and profiling and to create other data products and insights from location data. HB 2008’s definition of “sale” may potentially affect not just direct sales of precise location data but bundling and other licensing arrangements, subject to certain exceptions and uses. The new law will also add to customers’ due diligence process examining their data vendors’ collection practices.

UPDATE (April 17, 2025): The below reflects a development occurring after our publication of the original post.

On April 11, 2025, the National Security Division (the “NSD”) released several documents setting out initial guidance on how to comply with the Rule, which the NSD refers to as the Data Security

On July 11, 2022, the Federal Trade Commission (FTC) published “Location, health, and other sensitive information: FTC committed to fully enforcing the law against illegal use and sharing of highly sensitive data,” on its Business Blog.  The blog post is likely related to an Executive Order (the “EO”) signed by President Biden in the wake of the Supreme Court’s Dobbs decision. Among other things, the EO directed the FTC to consider taking steps to protect consumers’ privacy when seeking information about and related to the provision of reproductive health care services.

While this latest drumbeat on this issue came from the FTC, we expect to see attention to this issue by other regulators, including, perhaps, the Department of Justice as well as state attorneys general.

Although the FTC post centers on location data and reproductive health services, it is likely that there will be more scrutiny of the collection and use of location data in general. This renewed focus will potentially subject a wide group of digital ecosystem participants to increased attention.  The spotlight will likely fall on interactive platforms, app publishers, software development kit (SDK) developers, data brokers and data analytics firms – over practices concerning the collection, sharing and perceived misuse of data generally.

On June 15, 2022, Senator Elizabeth Warren introduced a bill, cosponsored by a host of other Democratic and independent Senators, the “Health and Location Data Protection Act of 2022,” which, subject to a few exceptions, would, among other things, prohibit the selling, sharing or transferring location data and health data. The bill gives the Federal Trade Commission (FTC) rulemaking and enforcement authority for violations of the law and also grants state attorneys general the right to bring actions; notably, the law would also give a private right of action to persons adversely affected by a violation of the proposed law.

This past week, the operator of the popular Weather Channel (“TWC”) mobile phone app entered into a Stipulation of Settlement with the Los Angeles City Attorney, Mike Feuer (“City Attorney”), closing the books on one of the first litigations to focus on the collection of locational data through mobile phones. (People v. TWC Product and Technology, LLC, No. 19STCV00605 (Cal. Super., L.A. Cty, Stipulation Aug. 14, 2020)). While the settlement appears to allow TWC to continue to use locational information for app-related services and to serve advertising (as long the app includes some agreed-upon notices and screen prompts to consumers), what is glaringly absent from the settlement is a discussion of sharing locational information with third parties for purposes other than serving advertising or performing services in the app. Because applicable law, industry practice and the policies of Apple and Google themselves have narrowed the ability to share locational information for such purposes, the allegations of the case were, in a sense, subsumed in the tsunami of attention that locational information sharing has attracted. While some are viewing this settlement as a roadmap for locational information collection and sharing, in fact the settlement is quite narrow.
